Trading conditions

1. Agreement

Read through our terms and conditions for online shopping at fiskin.no.

When you make a purchase, you accept our terms and conditions and a binding agreement is entered into forse between Yuliia Buhlak Fiskin and you as a customer. Note that the trading conditions can change, and should therefore be read every time you make a purchase at Yuliia Buhlak Fiskin.

We answer all questions via email within 24 hours on weekdays. 

Buyer:

The buyer is a consumer who makes the order, and is referred as the buyer/customer. 

3. Price:

All prices are in Norwegian kroner ( NOK ), including applicable VAT and all other taxes.

We reserve the right to price changes and price errors on our products.

Note that the offer is valid while stocks last and within the time frames that are informed about in our marketing.

We reserve the right for errors in our stock. If we are missing any of the items you have ordered, we will send the items we have in stock and credit the missing item(s), or cancel the order if we cannot deliver any of the items.

Discount codes always apply to ordinary goods and not to already discounted goods and cannot be combined with other discounts.  Certain discount codes are of a personal nature and we reserve the right to reject any sales and deactivate discount codes if we suspect misuse. A maximum of one discount code is allowed per order.

4. Products

All size recommendations are indicative and will naturally not fit everyone. If your product does not fit, The Basic Shop cannot be held responsible for the choice of size.

Images we use in the online store are illustrative and may differ from the item's actual appearance.

5. Conclusion of agreement

A purchase agreement is entered into force when the customer has received order confirmation via e-mail from Yuliia Buhalak Fiskin. It is assumed that the customer has provided correct information about e-mail address and physical address.

The agreement is not binding if there has been a writing or typing error in the offer from the seller in the ordering solution in the online store or in the buyer's order, and the other party realized or should have realized that there was such an error. For example, if a product has no price.

6. Payment:

Card/Vipps : 

You can pay with Visa, Mastercard and Vipps.

Select payment type and follow the instructions. The goods are sent directly after payment and there is no additional charge. 

8. Shipping

Free shipping for orders over NOK 899, after any discount.

For orders under NOK 899, the shipping cost is:

  • • NOK 139 when sending "Package to collection point". This package is collected at a selected collection point. 1-4 working days delivery time.
  • • NOK 89 when sending "Pakke i Postkassen". Then it will be delivered straight to your mailbox. 2-5 working days delivery time.

Note that for "Pakke i Postkassen" this only applies to shipments under 4 kg, and the shipping time is usually 1-2 days longer than "Pakke til hentested".

The risk for the goods passes to the buyer when he, or his representatives, have had the goods delivered in accordance with point 10. The seller is responsible for the goods until they are delivered to the buyer.

9. Right of withdrawal, return and exchange.

At Fiskin.no, you have a 30-day right to exchange, return and cancel unused goods. In order to make use of the right of exchange, return and cancellation, it is important that you notify us within 30 days of receiving the item.

Return shipping is paid by the customer. We have a fixed return shipping cost of NOK 79, which is deducted from the amount paid back. Return shipping is not charged for exchanges and complaints.

For all returns, the return form, which came with the shipment, must be filled in. If you are missing a return form, send us an email, contact@fiskin.no, 

Note that the right of withdrawal only applies to consumers and not business customers.

If you cancel the entire purchase, you will be refunded the value of the goods at the time of purchase, within 14 days after we have received and processed your return. You will receive an email when your return has been processed. If you have paid by card, the amount will be returned directly to the same card you used for the purchase.

Unused goods

In order to be refunded the full amount in case of return/right of cancellation, the item must be sent back in the same condition as when you received it. That is, in original packaging, with all tags attached, without odors or marks. If the original packaging is damaged, the item will be considered used and money will not be refunded.

Exchange

At www.fiskin.no we have free exchanges. The customer pays only a shipping fee. Please contact us via contact@fiskin.no.

10. Delivery and delays.

Fast delivery is a high priority for us! We do our very best to deliver as quickly as possible at all times. Orders received before 2 p.m. shipped the same day. Normal delivery time is from 1-4 working days within Norway. Our head office and warehouse are in Gjøvik, where you are also welcome to pick up your order if you want it the same day.

 

Please note that we reserve the right to delays during periods of high demand at Fiskin.no or Bring/Posten. If the delay (shipment date) is longer than 14 days, you as a customer have the right to cancel the purchase without any cost.

We send all packages with Bring/Posten unless otherwise agreed in connection with the order and are delivered by a method other than the standard delivery method.

 

If your package and/or its contents are damaged in transit when you receive the package from us, report this directly to the place of delivery (to us if the item was delivered in your mailbox).

 

If a package goes missing during transport, you must report this to our customer service within a reasonable time (no later than 14 days after expected arrival)..

Delivery method:

  • Pakke i Postkassen – Orders that have a low weight and volume can be delivered with the "Parcel in the Postbox" delivery method. The order will then be delivered directly to your mailbox. Maximum shipping limit is 2kg. Delivery time 2-5 working days.
  • Pakke til hentested - Orders that are picked up at a pick-up point of your choice. Maximum shipping limit is 35 kg. Delivery time 1-4 working days.
  • Pakke levert hjem - Bring delivers the package to you personally at your door. 1-4 working days.

 

Unclaimed package:

For packages that are not collected, we debit a fee of NOK 249. It corresponds to the costs we have to send out and have the package transported back to us. 

11. Complaints in the event of a defect in the product and deadline for reporting a claim.

If there is a defect in the goods, the buyer must within a reasonable time after it was discovered or should have been discovered, notify the seller that he or she wants to claim the defect. The buyer has always complained in sufficient time if it happens within 2 months from the defect was discovered or should have been discovered. Complaints can be made no later than two years after the buyer took over the item. If the item or parts of it are intended to last significantly longer than two years, the complaint deadline is five years. 

It is important that you have a receipt for your purchase. If you have the current order number for the complaint, it will be proof for us that the item was purchased in our store.

In the event of a complaint, the customer will be reimbursed the same amount for the complaint item as when it was purchased, or a new item if we still have the product in stock.

Exchanges and returns often take up to 3 weeks from when you have sent the item back. A return form is physically attached to your order or you can claim it at contact@fiskin.no.

In the same way that it is our responsibility that the package reaches you, it is your responsibility as the customer that the package reaches us. If you choose a tracking package, you are absolutely sure that it will not disappear. If you choose a cheaper variant without tracking, you have less control over where your package is. 

12. The seller's rights in the event of the buyer's default

If the buyer does not pay or fulfill the other obligations under the agreement, and this is not due to the seller or conditions on the seller's side, the seller may, in accordance with the rules in the Consumer Purchase Act, Chapter 9, depending on the circumstances, withhold the goods, demand fulfillment of the agreement, demand the agreement be canceled and compensation from the buyer. The seller may also, depending on the circumstances, be able to demand interest for late payment, debt collection fees and fees for non-prepaid uncollected goods.

13. Guarantee / Personal data / Age / Conflict resolution / Force Majeure

A guarantee given by the seller gives the buyer rights in addition to those the buyer already has under non-derogable legislation. A guarantee thus implies no restrictions on the buyer's right to complaint and claim in the event of delay or defects according to points 9 and 10.

Personal data will not be passed on to any other parties, but used to carry out the agreement with the buyer. Yuliia Buhlak Fiskin processes personal data in accordance with current legislation, including the EU's privacy regulation.

Age: You must be over 15 years of age to carry out a trade with us. If you shop by invoice, the age limit is 18 years.

Conflict resolution: Complaints are addressed to the seller within a reasonable time, cf. Clauses 9 and 10. The parties must try to resolve any disputes amicably. If this is not successful, the buyer can contact the Consumer Council for mediation.

Force Majeure: Yuliia Buhlak Fiskin is exempt from liability for breach of certain obligations in relation to these general terms and conditions, if the breach is due to extenuating circumstances as described below, and these circumstances prevent, make difficult or delay compliance with obligations. Circumstances exonerating liability include acts or failure of authorities, new or amended legislation, conflict on the labor market, blockade, fire, flood, sabotage or major accidents. Decisions by public authorities that affect the market and products in a negative direction are considered force majeure, for example warning texts, sales bans etc., or an abnormal decline in the market.
